1. Acceptance of Terms

By accessing or using OpsCtrl's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to update these terms at any time, and your continued use of our services constitutes acceptance of any changes.

2. Description of Service

OpsCtrl provides a Platform-as-a-Service (PaaS) specifically designed for NestJS applications. Our service includes automated deployment, database provisioning, SSL certificates, log management, and related infrastructure services. We reserve the right to modify, suspend, or discontinue any part of the service at any time.

3. Account Registration

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You may not use another person's account without permission
• You must be at least 18 years old to create an account

4. Acceptable Use

• You may not use our services for any illegal or unauthorized purpose
• You may not deploy applications that contain malware, viruses, or malicious code
• You may not attempt to gain unauthorized access to our systems or other users' accounts
• You may not use our services to send spam or unsolicited communications
• You may not use our services to mine cryptocurrency without explicit permission
• You may not exceed the resource limits of your subscription plan

5. Payment and Billing

Paid plans are billed in advance on a monthly basis. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days notice. If you do not agree to a price change, you may cancel your subscription before it takes effect.

6. Service Level Agreement

We strive to maintain 99.9% uptime for all paid plans. In the event of service disruptions exceeding our SLA commitments, eligible customers may receive service credits as outlined in our SLA documentation. The Starter plan does not include SLA guarantees.

7. Data and Content

You retain all rights to your applications and data deployed on our platform. You grant us a limited license to host, store, and transmit your content solely for the purpose of providing our services. You are responsible for maintaining backups of your data. We are not liable for any loss of data.

8. Intellectual Property

OpsCtrl and its original content, features, and functionality are owned by OpsCtrl and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, OpsCtrl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

10. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use our services will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OpsCtrl is incorporated, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved through binding arbitration.
